THE HANDSHAKES NINTENDO SWITCH LUCKY DRAW

The Handshakes Nintendo Switch Lucky Draw (the “Lucky Draw”) is conducted by DC Frontiers Pte Ltd (also known as “Handshakes”) to encourage sign-ups and utilisation of its Handshakes DATAMART product.

The following terms and conditions (“T&Cs”), and all subsequent revisions or amendments thereafter made by Handshakes, without prior notice, shall apply to the Lucky Draw.

1. 1. The Lucky Draw and selection of winner for the Lucky Draw (“Winner”) will be held and determined on 7 December 2023 (“Draw Date”) at the office of Handshakes at 190 Middle Road, #20-08 Fortune Centre, Singapore 188979, between 10am to 6pm.

Eligible Participants

For the purposes of the Terms, the following definitions shall apply unless the context requires otherwise:

1. 2. As a condition of entry into the Lucky Draw, each participant affirms and represents that he/she is above 18 years of age and agrees to be bound in all respects by these T&Cs

   3. All new and existing Handshakes DATAMART subscribers will be eligible to enter into the Lucky Draw (“Eligible Participants”).

   4. All employees of Handshakes are not eligible to enter into the Lucky Draw.

Lucky Draws

For the purposes of the Terms, the following definitions shall apply unless the context requires otherwise:

1. 5. Eligible Participants must sign up for a Handshakes DATAMART account and successfully activate their account by logging in to the Handshakes DATAMART portal with the credentials provided after submission of account creation form.

   6. Participation in the Lucky Draw entitles Eligible Participants one (1) chance to win the Lucky Draw Prize. Eligible Participants who sign up for a Handshakes DATAMART account at the Big Data & Ai World Event (11-12 October 2023) & Singapore Fintech Festival (15-17 November 2023) will be entitled to two (2) chances of winning the prize. All Eligible Participants must activate their respective Handshakes DATAMART account latest by 30 November 2023.

   7. During the Draw Date, Eligible Participants will be randomly selected using online portal www.wheelofnames.com. Names of Eligible Participants will be tabulated and Eligible Participants who signed up at the abovesaid events will have their names appeared twice. A designated Handshakes representative will be responsible for conducting the draw in the presence of a scrutineer who is not associated with Handshakes or otherwise involved in the conduct of the Lucky Draw.

   8. The Winner will be notified via their registered email as per their Handshakes DATAMART account creation within 7 days from the Draw Date.

   9. Handshakes may publish the name of the Winner of the Lucky Draw on its website at www.handshakes.com.sg or on its LinkedIn and Facebook handles.

   10. Handshakes reserves the right to substitute any Winner subsequently found to be ineligible or disqualified with reserved finalists.

Prizes

1. 11. The Winner can collect their prize at 190 Middle Road #20-08 (S) 188979 from 11 to 29 December 2023 between 10am to 6pm upon prior appointment made for this purpose.

   12. Any unclaimed Prize after 29 December 2023, 6pm will be forfeited. The Winner whose Prize has been forfeited hereunder shall not be entitled to any payment or compensation.

   13. Prize must be collected as stated and no compensation will be payable if a Winner is unable to use the Prize. There shall be no refund or exchange for any partially used or unused Prize.

   14. The available Prize shall be a Nintendo Switch. Handshakes may at any time and without notice in its sole and absolute discretion and without assigning any reason, substitute any Prize with any other item of a similar value.

General Terms and Conditions

1. 15. Handshakes shall have the right to disclose and publish the name and any other particulars of the winner for publicity purposes and the Winner shall consent, co-operate and participate fully in the activities organised by Handshakes for such purposes, without any payment, fee or compensation whatsoever. If the Winner has collected the Prize but does not comply with these obligations, he/she shall be required to return the Prize to Handshakes.

   16. By participating in the Lucky Draw, the Eligible Participants agree that any and all personal data submitted may be collected, used and/or disclosed by Handshakes for the following purposes:

       1. 1. Communication with the Eligible Participants for purposes related to the Lucky Draw;

          2. Such other purposes as Handshakes may reasonably deem appropriate, or in relation to which the Eligible Participants have otherwise provided Handshakes with consent; and/or 

          3. to promote and advertise the Lucky Draw

   17. Handshakes reserves the right to engage photographers and videographers to take photographs and/or video recordings. By participating in the Lucky Draw, Eligible Participants consent to being photographed and recorded by authorised photographers and videographers and consent to Handshakes use of such images, films or recordings for creating marketing and publicity materials for public transmission.

   18. Eligible Participants who fail to provide true, correct and accurate information when participating in the Lucky Draw shall automatically be disqualified from the Lucky Draw.

   19. Handshakes shall make no representation, warranty or undertaking whatsoever as to any implied terms or conditions with respect to any Prize. The Prize provided are on an “as-is” basis.

   20. The Prize is non-exchangeable, non-transferable and no cash alternative will be offered.

   21. Handshakes will not in any circumstances be responsible or liable to compensate the Winner and/or Eligible Participant or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize or participation in the Lucky Draw. To the maximum extent permitted by law, each Winner and/or Eligible Participant agrees to indemnify Handshakes against any losses, damages, costs, expenses, claims or liabilities of any kind arising in connection with his or her participation in the Lucky Draw.

   22. The decision of Handshakes regarding any aspect of the Lucky Draw is final and binding.

   23. Handshakes reserves the right to hold void, cancel, suspend, or amend the Lucky Draw at its sole and absolute discretion.

   24. By participating in the Lucky Draw, the Eligible Participant agrees to be bound by and to comply with these T&Cs including all amendments, additions, replacements and modifications hereto as may from time to time be made by Handshakes. Handshakes reserves the right to refuse to award the Prize to anyone in breach of these terms and conditions.

   25. The T&Cs are not intended to confer rights to any third party under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any provision of these T&Cs, and the operation of the said Act is hereby excluded.

   26. Any provision of these T&Cs which are found to be illegal, unlawful, invalid, void or unenforceable in whole or in part, shall be deemed not to form part of these T&Cs, and the validity of the other provisions of these T&Cs and / or the remainder of the provision in question (if any) shall not be affected.

   27. The Lucky Draw shall be governed by Singapore law and all Winners and/or Eligible Participants agree to submit any claim, dispute or controversy to the non-exclusive jurisdiction of the courts of the Republic of Singapore.
